Terms of Service

These Terms of Service ("Terms") govern your use of the Smart Traveler application ("the App") published by Philippe B. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

Smart Traveler is a travel companion application that provides currency conversion, world clock, AI-powered translation, local news, and safety information based on your device's location. The App acts as a client interface to public APIs and third-party AI services — it does not operate servers, store your data remotely, or provide AI services directly.

2. User Responsibilities

• AI API Keys — If you use the OpenAI or Google Gemini translation providers, you are responsible for obtaining and managing your own API keys. You are solely responsible for any costs incurred through your use of those third-party APIs.
• Accuracy — Currency rates, translations, and news content are provided for general informational purposes. You should not rely solely on this App for financial decisions, safety-critical situations, or legal or medical matters.
• Emergency Information — The emergency numbers and safety tips provided in the App are sourced from publicly available information and may not be complete or up to date. Always verify emergency contact information through official local sources.

3. Advertisements and In-App Purchases

• The free version of the App displays advertisements served by Google AdMob. These ads are subject to Google's terms and policies.
• The "Remove Ads" in-app purchase is a one-time, non-consumable purchase that permanently removes all advertisements. It is processed by Apple's App Store and is non-refundable except as required by applicable law.
• The "Remove Ads" purchase is tied to your Apple ID and can be restored on any device signed into the same Apple ID using the "Restore Purchase" option in the App's Settings.

4. Third-Party Services

The App relies on third-party services that are outside our control. Your use of these services is governed by their respective terms:

• OpenAI — openai.com/policies/terms-of-use
• Google Gemini — ai.google.dev/terms
• Google AdMob — policies.google.com/technologies/ads
• Open Exchange Rates — open.er-api.com
• Apple (StoreKit, Translation, Speech) — Apple Standard EULA

We are not responsible for the availability, accuracy, or conduct of any third-party service.

5. Accuracy Disclaimer

While we strive to provide accurate and up-to-date information:

• Currency rates are indicative only and may differ from the rates offered by banks, currency exchanges, or payment processors.
• AI translations may contain errors and should not be used for legal, medical, or safety-critical communications without independent verification.
• News content is aggregated from third-party RSS feeds and we are not responsible for its accuracy or completeness.
• Safety and emergency information may be incomplete or outdated. Always verify through local official sources.

6. No Warranty

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or accurate at all times.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Philippe B shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Financial losses resulting from reliance on currency rates or translation errors.
• Costs incurred from third-party AI API usage.
• Failure to access emergency services or accurate emergency information.
• Data loss or security issues resulting from device compromise.

8. Intellectual Property

The App, including its design, code, and content, is the property of Philippe B and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without express written permission.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the App after any modification constitutes acceptance of the revised Terms.

10. Termination

You may stop using the App at any time by deleting it from your device. Deleting the App removes all locally stored data including API keys and preferences.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
